The financial cost of non-compliance

As responsible landlords the legally required checks and tests are diligently performed, but did you know to be compliant you also need to evidence that your tenants have been issued a copy of the certificate, be that Gas Safety, an EICR, or an EPC. 

The potential financial penalties could be: 

  • Gas Safety – up to £6,000 per breach. 
  • Electrical Safety – up to £30,000 for not providing an EICR or failing to complete necessary repairs. 
  • EPC Certificates – up to £5,000 per property without a valid EPC or failing to meet the Minimum Energy Efficiency Standards (MEES).

Energy Performance Certificate (EPC) requirements

Social housing providers have a target set by UK government to achieve a minimum EPC rating of C for rented properties by 2035 (2030 for “fuel poor” households). Furthermore, properties with an EPC rating below E are considered substandard and cannot be let unless exempt. 

As a landlord you should: 

  • Provide tenants with a valid EPC, obtained before the property is marketed for rent. 
  • The EPC must be made available, free of charge to prospective tenants.
